Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and [LEGAL ENTITY NAME] ("Puls", "we", "us"), the operator of puls.work. By creating an account or using Puls, you agree to these Terms, our Acceptable Use Policy, and our Privacy Policy. If you do not agree, do not use the service. If you use Puls on behalf of a company, you represent that you have authority to bind that company, and "you" refers to it.

2. Service Description

Puls is an AI-powered social media management platform that helps you generate, schedule, and publish content across multiple social media platforms. We may add, change, or remove features as the product evolves; we will not materially reduce the core functionality of a paid plan during a paid period without notice.

3. Accounts & Access

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to use Puls. One person or entity may not maintain more than one free account. You must provide accurate account information and keep it current.

4. Subscriptions, Auto-Renewal & Billing

Paid plans are billed monthly or annually through Stripe. Free trials last 7 days and can only be claimed once per account; if you do not cancel before the trial ends, your plan converts to a paid subscription.

Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annually) at the then-current rate until you cancel. You can cancel anytime through the billing portal; cancellation takes effect at the end of the current paid period and you retain access until then. See our Refund & Cancellation Policy for details.

Price changes. We may change prices with at least 30 days' notice; changes apply from your next renewal, and you may cancel before they take effect.

5. Content, Ownership & AI Disclaimer

You retain ownership of all content you submit to or create with Puls. You grant us a limited, worldwide, non-exclusive license to host, process, and transmit that content solely to operate the service — including sending it to the AI providers that power generation and publishing it to the social accounts you connect, at your direction. Puls and its software, design, and branding remain our property; we grant you a limited, non-transferable right to use the service during your subscription.

You are responsible for ensuring that content you publish complies with the terms of each social media platform and applicable law (including disclosure rules for advertising and AI-generated media where they apply).

AI-generated content. Puls uses third-party AI models to generate text, images, and video. AI output may be inaccurate, biased, incomplete, or unintentionally similar to existing material, and may not reflect real-time facts. It is provided "as is." You are solely responsible for reviewing, fact-checking, and confirming you have the rights to publish any output before it goes live. By submitting content to Puls you consent to it being processed by the AI subprocessors listed on our Subprocessors page.

6. Third-Party Platforms

Puls connects to social platforms (X, LinkedIn, Meta, TikTok, YouTube, and others) through their official APIs. Puls is not affiliated with or endorsed by these platforms. Their APIs, rate limits, and policies are outside our control and may change or become unavailable, which can affect publishing or analytics. Your use of each platform remains governed by that platform's own terms.

7. Usage Limits

Each plan has monthly limits on posts and video generations. Limits reset at the start of each billing period. Exceeding limits requires upgrading your plan. We may apply fair-use safeguards to protect the service from abuse.

8. Acceptable Use

You may not use Puls to generate spam, misleading content, hate speech, or content that violates applicable laws or platform rules. The full rules are in our Acceptable Use Policy, which is part of these Terms. We may suspend or terminate accounts that violate it.

9. Termination

You can stop using Puls and delete your account at any time from your settings. We may suspend or terminate your access for material breach of these Terms or the AUP, for non-payment, or where required by law — with notice where practicable. On termination your right to use the service ends; data deletion is handled as described in the Privacy Policy. Sections that by their nature should survive (ownership, disclaimers, liability limits, disputes) survive termination.

10. Disclaimer of Warranties

Puls is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI output will be accurate or achieve any particular result or engagement.

11. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data. Our total aggregate liability arising out of or relating to the service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim and (b) USD 100. Nothing in these Terms excludes liability that cannot be excluded by law (including for fraud, or death or personal injury caused by negligence), and nothing limits mandatory consumer rights in your country of residence.

12. Indemnification

You will indemnify and hold Puls harmless from third-party claims arising out of content you create, publish, or import through the service, your violation of these Terms or the AUP, or your violation of any law or third-party right — except to the extent caused by our own breach of these Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of [GOVERNING LAW JURISDICTION], excluding its conflict-of-law rules, and the courts of [VENUE] have exclusive jurisdiction — except that consumers in the EEA/UK retain the protection of the mandatory rules and courts of their country of residence. Before filing a claim, please contact us at hello@puls.work — most issues can be resolved informally.

14. Changes to Terms

We may update these Terms from time to time. For material changes we will give at least 14 days' notice by email or in-app. Continued use of the service after changes take effect constitutes acceptance; if you do not agree, cancel before the effective date.
